OFFICIAL RULES AND REGULATIONS

  1. The Task GET READY FOR SUMMER Contest starts at 12:00:01 a.m. Atlantic Time ("AT") on April 1, 2012 and closes on June 30, 2012 at 11:59:59 p.m. Pacific Time (PT) (the "Contest Period"). Contestants can enter in-store at participating Task retailers or online. There are three (3) Grand Prizes (the "Grand Prizes") available to be won from among all the eligible entries received in-store or online during the Contest Period. The database of all eligible entries received during the Contest Period will be split into the following three regional groups (each a "Region") - (1) Western (British Columbia, Alberta, Saskatchewan, Manitoba, North West Territories, Yukon), (2) Eastern (Ontario, New Brunswick, Nova Scotia, Newfoundland & Labrador, Prince Edward Island, Nunavut), and (3) Quebec. One (1) Grand Prize Winner will be drawn from the Western group, one (1) Grand Prize Winner will be drawn from the Eastern group, and one (1) Grand Prize Winner will be drawn from Quebec. No Purchase Necessary. Void where prohibited.
  2. How to enter the contest: Contestants can enter online or in-store. To enter online, simply visit the web site located at www.task-tools.com/contest, click on the Register Now button and complete and submit your entry by following the instructions found at the site. All entries must include your name, address, age, ten digit day and evening telephone numbers and e-mail address. By registering you will receive one (1) entry into the Contest. Limit of one (1) online entry per individual throughout the Contest Period regardless of the email address, telephone numbers, or addresses provided. Entries received on-line shall be deemed to be submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. To enter in-store, complete and submit your entry by entering your name, address, age, ten digit day and evening telephone numbers and e-mail address into a ballot form found at a participating Task retailer. By completing a ballot you will receive one (1) entry into the Contest. Limit of one (1) in-store entry per individual throughout the Contest Period regardless of the email address, telephone numbers, or addresses provided.
  3. Ballots: A total of 50,000 ballot forms will be produced for this Contest. The ballot forms will be available from participating Task retailers from April 1, 2012 to June 30, 2012 or while supplies last, whichever occurs first.
  4. The Contest Sponsors are Task Tools / Caplan Industries Inc. Prize sponsor for this contest is Napoleon Appliance Corporation.
  5. To enter and to be eligible to win the Contest an entrant must be a legal resident of Canada and be over the age of majority in his or her province or territory of residence. Employees and their parents, siblings and children, and persons domiciled with an employee of any of the Contest Sponsors, their agents, parent, affiliated or related companies, subsidiaries, divisions, successors and assignees of the Contest Sponsors, and promotional and advertising agencies and administrators, are ineligible to enter. In order to be eligible to win a Grand Prize must answer a skill testing question as defined below.
  6. 6. There are three (3) Grand Prizes available to be won in the Contest. Each Grand Prizes consist of one (1) Napoleon Prestige Gourmet Grill (model # P308 RB). Grand Prizes must be accepted as awarded. No cash alternatives, substitution or transfers of the Prizes will be allowed. Each Grand Prize will be forwarded to the TASK retailer located closest to the Finalist's home within four (4) to (6) weeks from the date when the Finalist's signed Indemnity and Release Form is received by Task Tools. Finalists are solely responsible for all costs related to pick up and/or delivery of the Grand Prize from the Task retailer including, without limitation, transportation costs, applicable taxes, fuel surcharges and all personal expenses of any kind or nature. Retail value of the Grand Prize is $699.
  7. Prize draws: The database of all eligible entries received during the Contest Period will be split into the following regional groups - (1) Western (British Columbia, Alberta, Saskatchewan, Manitoba, North West Territories, Yukon), (2) Eastern (Ontario, New Brunswick, Nova Scotia, Newfoundland & Labrador, Prince Edward Island, Nunavut), and (3) Quebec (each a "Regional Group"). On or after July 6, 2012 at 9:30 a.m. PT, a random draw will take place at the Task Tools Head Office in Delta, BC. The first entry drawn from each Regional Group will be eligible to win one of the three (3) Grand Prizes. The odds of winning a Grand Prize will depend upon the total number of eligible entries received during the Contest Period. Task Tools, acting reasonably, will attempt to contact the potential Grand Prize winners by telephone and e-mail on the day of the draw. If there is no answer at the telephone numbers provided, a voice mail message will be left if the service is available. In the event a potential winner cannot be contacted within twenty-four (24) hours after the initial phone call, he or she will be disqualified and an alternate potential winner will be drawn from the same Regional Group. For clarity, any contact by e-mail is as a courtesy only and the Contest Sponsors shall not be responsible if the potential winner does not receive an email for any reason whatsoever. Unless otherwise determined by the Contest Sponsors in their sole discretion, the determination of timing for disqualification shall be solely based on telephone method of contact. Proof of identification must be provided upon request. In order to be declared a winner, potential winner must first correctly answer, unaided, a time limited mathematical skill testing question administered by Task Tools. Before being awarded any Grand Prize, each potential winner, or, if under the age of majority, his or her parent or legal guardian, will be required to sign and return, within the time stipulated by the Contest Sponsors, a full Release and Indemnity form as provided by the Contest Sponsors, stating that he/she has read and understood these Rules, grants all consents required, authorizes the Contest Sponsors to broadcast, publish and disseminate his/her name, city of residence, photograph, likeness, sobriquet and voice, in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no additional compensation to the potential winner, beyond the awarding of the Grand Prize, accepts the Prize as offered and releases the Contest Sponsors and their agents, parents, affiliated or related companies, subsidiaries, divisions, franchisees, prize sponsors, and promotional and advertising agencies and administrators from any and all liability of any kind arising out of the potential winner's participation in this Contest and receipt and use of the Grand Prize. In the event that a potential winner, does not comply with all the provisions as contemplated in these Rules, Contest Sponsors shall have the right to disqualify the potential winner and draw an alternate potential winner from the same Regional Group and the Contest Sponsors shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner, shall be applied, with the necessary amendments, until a qualified winner have been duly selected, but no potential Grand Prize winner will be selected after July 14, 2012.
  8. By entering this Contest the entrants and participants automatically agree to accept and abide by these Rules. All decisions of the Contest Sponsors and/or Judges with respect to any aspect of this Contest, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Contest. The Contest Sponsors reserve the right in their sole discretion to make their decisions in respect of eligibility of any Grand Prize winner at any time, and in particular, the Contest Sponsors reserve the right to consider the Contest Sponsors' insurer's determination as to eligibility in making such decisions. For greater certainty, participation as a Grand Prize winner does not constitute a determination as to eligibility in accordance with these Rules.
  9. By entering this Contest, all entrants fully and irrevocably releases, forever discharges and agrees to indemnify the Contest Sponsors, and their respective parent, subsidiary and affiliated companies, successors, employees, agents, partners, licensees and assigns, advertisers, promotional agencies and administrators from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims, demands or damages (including legal fees and expenses), whether known or unknown, whatsoever, both in law and in equity (including but not limited to claims based on negligence, breach of contract and fundamental breach and liability for physical injury, death, or property damage) and hereby waives his/her rights to sue for infringement of statutory and or common law personality, privacy and or trade-mark rights which the entrant or his/her administrators, heirs, successors or assigns might now have or may hereafter have, by reason of or arising out of the entrants participation in this Contest.
  10. In the event that the possession, use or fulfillment of a Prize by the undersigned carries any degree of physical risk or peril, the entrant warrants that he/she is in good physical health and assumes all risks and peril, including bodily injury or death that may arise from the possession, use or fulfillment of the Prize. The entrant agrees that the Contest Sponsors accept no responsibility or liability in this regard, and that the entrant will take steps that he/she considers appropriate to acquire complete information about such risks or perils and to acquire adequate protection and insurance against such risks and perils.
  11. In the event a Grand Prize winner does not comply with all or any of the provisions as contemplated in these Rules, the Contest Sponsors shall have the right to disqualify the potential winner at any time. If a Grand Prize winner is disqualified, the Contest Sponsors shall have the sole discretion to proceed. All determinations on whether and when to disqualify or move on from any contestant and the selection of which of the alternate contestants to advance are in the sole discretion of the Contest Sponsors, who will consider issues of timing, availability and logistics in making that determination.
  12. All entries become the property of Contest Sponsors who assume no responsibility for garbled, lost, late, illegible, incomplete, delayed, destroyed or misdirected mail, ballots, voice messages, e-mail or any computer errors or malfunctions. No correspondence will be entered into except with entrants requesting Rules by mail or requesting names of Prize winners (for which a self-addressed, postage paid envelope must be included). Contest Sponsors and their agents, parents, affiliated or related companies, subsidiaries, divisions, franchisees, prize sponsors, and promotional and advertising agencies and administrators do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials/data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsor, in their sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond their control, Contest Sponsors reserve their right to cancel, terminate, modify, amend, extend or suspend the Contest including cancelling any method of entry, and select a winner from previously received eligible entries. Contest Sponsors reserve their right (subject only to the consent of the Regie des alcools, des course et des jeux) to modify the Rules without materially affecting the terms and conditions hereof. The Contest Sponsors reserve their right in their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Contest Sponsors in their sole discretion, further reserve their right (subject only to the consent of the Regie des alcools, des course et des jeux) to terminate the on-line portion of the Contest and conduct the drawing from all on-line entries previously received during the Contest Period. Any attempts to deliberately damage the Contest web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsor reserve their right to seek remedies and damages to the fullest extent of the law. Contest Sponsors shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant's computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest web site, where applicable.
  13. Contest is subject to all applicable federal, provincial and municipal laws and regulations. Personal information collected from entrants will be used by the Contest Sponsors for the purpose of administering the Contest and, if consent is given at the time of entry, to provide the entrants with information relating to upcoming promotions of the Contest Sponsor, up-dates or special offers and/or promotional announcements. Entrants are able to opt in to receive such marketing information. Contest Sponsors will not sell, share or otherwise disclose personal information of entrants with third parties, other than to third parties engaged by them to fulfill the above purposes or as permitted or required by law. By entering the Contest, entrants consent to the manner of collection, use and disclosure of personal information as set out in the Task Tools Privacy Policy available at www.task-tools.com. Any inquiry concerning the personal information held by Task Tools should be addressed to Task Tools, 6800 Dennett Place, Delta, BC, V4G 1N4.
  14. For Quebec residents, any litigation respecting the conduct or organization of this Contest may be submitted to the Regie des alcools, des courses et des jeux du Quebec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement. In the event of any inconsistency between the English version and the French version of these rules and regulations, the English version shall govern to the extent necessary.
  15. Grand prize winners will be required to fill out the following information and sign the release as indicated below:
